Terms of Service

Welcome to AktivLang. These Terms of Service ("Terms") govern your use of the AktivLang mobile application ("App") and related services provided by AktivLang ("we", "our", or "us"). By using our App, you agree to these Terms.

1. Acceptance of Terms

By downloading, installing, or using AktivLang, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

AktivLang is a language learning application that provides:

• Daily writing prompts in various target languages
• AI-powered feedback on your writing
• Progress tracking and learning insights
• Personalized learning experiences

3. Account Registration

To use certain features of AktivLang, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

4. Subscription and Payments

4.1 Subscription Plans

AktivLang offers subscription plans that provide access to premium features. Subscription details, including pricing and features, are displayed in the App.

4.2 Billing

Subscriptions are billed through your Apple App Store or Google Play Store account. By subscribing, you authorize the applicable app store to charge your payment method.

4.3 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions through your device's app store settings.

4.4 Refunds

Refund requests are handled by Apple or Google according to their respective refund policies. We do not directly process refunds for app store purchases.

4.5 Price Changes

We may change subscription prices at any time. Price changes will not affect your current subscription period but will apply to subsequent renewals.

5. User Content

5.1 Your Content

You retain ownership of the content you create in AktivLang, including your written responses to prompts. By using the App, you grant us a license to process your content to provide our services, including generating feedback.

5.2 Content Guidelines

You agree not to submit content that:

• Is illegal, harmful, or offensive
• Infringes on intellectual property rights
• Contains malware or harmful code
• Violates the privacy of others
• Is spam or commercial solicitation

6. AI-Generated Feedback

AktivLang uses artificial intelligence to provide feedback on your writing. While we strive for accuracy, AI-generated feedback may contain errors. The feedback is provided for educational purposes and should not be considered professional language instruction.

7. Intellectual Property

The App, including its design, features, content, and underlying technology, is owned by AktivLang and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App without our written permission.

8. Prohibited Uses

You agree not to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Use automated systems to access the App
• Share your account with others
• Resell or commercially exploit the App

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF THE APP IS AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AKTIVLANG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless AktivLang from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

12. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason. You may terminate your account at any time by contacting us or deleting your account through the App.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or by email. Continued use of the App after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles. Any disputes shall be resolved in the courts of the Netherlands.

16. Severability

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AktivLang regarding your use of the App.
